German crypto tax: frequently asked questions
Short answers to the questions clients and enquirers ask most, from the holding period to voluntary disclosure and leaving Germany. Where there is more to say, a link leads to the full article.
Tax and holding period
How much tax do I pay on Bitcoin gains in Germany?
It depends on how long you held. If more than twelve months lie between purchase and sale, the gain is tax free for private investors (section 23 of the Income Tax Act). Within twelve months it is taxed at your personal income tax rate; there is no flat rate. Total gains up to €1,000 per calendar year stay tax free, and once the limit is reached the whole amount is taxable. See holding period.
How does the German tax office find out about my crypto gains?
Through collective information requests to exchanges, tip-offs from audits of third parties, and from 2026 through the automatic exchange of information under DAC8. Providers report for the first time by 31 July 2027, covering the year 2026 and existing account relationships. Details: DAC8. This applies to anyone resident in Germany, whatever the nationality or the exchange used.
Which part of the tax return is crypto reported in?
Private disposals and income from staking, lending, mining and airdrops go in Annex SO, in different sections. Annex SO shows totals; the detailed list is attached or provided on request. See Annex SO explained.
Proposed change: abolishing the holding period
When will the abolition of the holding period be decided?
Not yet, and the ministry draft is not a law. The Federal Cabinet is scheduled to take it up on 14 October 2026, followed by the Bundestag and Bundesrat and finally promulgation. Until then the one-year holding period in section 23 of the Income Tax Act continues to apply. See the draft bill.
What tax would the draft bill introduce?
For crypto assets acquired after 31 December 2026 the draft provides a flat tax of 25 per cent, plus solidarity surcharge and possibly church tax. According to its explanatory part, existing holdings stay under the current rules. This is the status of a draft, not current law.
Which parties are for and against?
The Green Party bill to abolish the holding period was rejected in the Bundestag finance committee with the votes of CDU/CSU, AfD and SPD. The Greens voted for it and the Left supported the initiative while criticising weaknesses. The SPD wanted to wait for proposals from the Finance Ministry, which now exist as the draft. The camps do not follow coalition lines. See holding period.
Voluntary disclosure and tax investigation
How does a voluntary disclosure for undeclared Bitcoin work?
To be effective under section 371 of the Fiscal Code it must be complete: all unbarred tax offences of the tax type concerned, at least the last ten calendar years. The transaction history is rebuilt first, the tax is calculated, and the disclosure is filed with a full derivation. Tax and interest must be paid within the period set. A partial disclosure does not protect you. See voluntary disclosure.
What is the difference between a correction and a voluntary disclosure?
A correction under section 153 of the Fiscal Code is enough where there was neither intent nor gross negligence when the return was filed and you only recognised the error later; it must then be made without undue delay. If you did not declare with intent, including conditional intent, a correction alone does not give immunity: that needs a voluntary disclosure under section 371. For gross negligence, section 378(3) provides a comparable correction with a payment deadline. Which case applies depends on what you knew at the time. Classify it before filing anything, because the wrong form can cost you the protection.
What does a voluntary disclosure cost?
Tax plus interest. If the evaded amount exceeds €25,000 per tax type and year, a surcharge under section 398a applies: 10 per cent up to €100,000, 15 per cent up to €1 million, 20 per cent above. Our fee is on top; a voluntary disclosure adds €2,950 to the fee for the returns (fees).
What should I do if I receive a letter about my crypto?
Note the deadline and do nothing else: do not call, reply or send documents. First establish what kind of letter it is; an information request, an audit order and the opening of criminal proceedings have very different consequences, and a well-meant reply can rule out a voluntary disclosure. See tax investigation.
Source of funds and your bank
Why does my bank ask where my Bitcoin comes from?
Banks are obliged parties under the Anti-Money Laundering Act. They must establish and document the origin of funds and, where there are indications, report to the Financial Intelligence Unit without telling you. Crypto counts as higher risk, so banks ask more closely and block accounts sooner. See source of funds.
What documents do I need to prove the source of my crypto?
Bank statements and evidence for the original money (salary, sale, inheritance, loan), transfer receipts to the exchange, machine-readable exports from every exchange, your wallet addresses, deposit and withdrawal histories, and the purchase contract or financing commitment for the use of the funds. Tax-free status after the holding period does not replace this.
Inheritance and gifts
How is inherited Bitcoin taxed in Germany?
Inheritance tax is based on the market value on the date of death; a later price fall does not reduce it. The deceased person's holding period carries on for the heir (section 23(1) sentence 3 of the Income Tax Act). The acquisition must be reported to the tax office within three months of becoming aware of it. See inheritance and gifts.
How high is gift tax?
It depends on the relationship. Allowances per donor every ten years: spouse €500,000, child €400,000, grandchild €200,000 (with living parents), siblings, nieces and nephews €20,000, all others €20,000. Rates are 7 to 30 per cent in class I, 15 to 43 per cent in class II and 30 to 50 per cent in class III. The value is taken on the day the gift is carried out.
Leaving Germany
What happens to my Bitcoin if I leave Germany?
Leaving does not in itself trigger German tax on crypto held privately. Whether a later sale is taxed depends on the law of your new country and the tax treaty; the German holding period carries on. It is different for shares in a company (section 6 of the Foreign Tax Act) and when moving to a low-tax country (section 2, extended limited tax liability). See leaving Germany and destination countries.
How high is the exit tax?
None on Bitcoin held directly as a private individual. Exit taxation under section 6 applies to shares in corporations, for example if your coins sit in a GmbH. In our reading, the draft bill on abolishing the holding period does not provide for exit taxation on crypto.
Companies, DeFi, staking and NFTs
How do I account for crypto in my company?
Crypto assets are measured individually; every disposal is a separate transaction with its own cost. Merely marking to market is not enough. The cost-flow method you choose decides each result and must be applied consistently and documented. See crypto accounting.
Which adviser knows DeFi and staking?
Matthias Steger has worked in crypto since 2016. Staking rewards are other income under section 22 no. 3 of the Income Tax Act when received, with a €256 exemption limit; staking does not extend the holding period. See staking, lending and DeFi.
Which adviser knows NFT taxation?
The treatment depends on what is actually done: buying and selling NFTs as a collector, or creating and selling them as a creator. A sale can be a service supplied electronically, in which case VAT turns on place of supply and the status of the customer. We assess NFTs case by case, including through expert opinions; for projects see blockchain projects.
Fees and timing
What does it cost to have my crypto data prepared and filed?
The income tax return with crypto starts at €2,380 per tax year, including five hours for checking and processing transactions. Further time is billed by effort, which we estimate in advance. All amounts are minimum fees; see fees.
How long does it take?
From the first conversation to filing the return takes two to six weeks, depending on the data. A voluntary disclosure takes four to twelve weeks from the first conversation. We give the timeframe together with the effort estimate.
Can we work in English?
Yes. Calls and explanations are in English; the return itself is filed in German because ELSTER and the forms exist only in German. See the contact page.
Note: The answers reflect the position on 13 October 2026 and do not replace advice on your individual case. The ministry draft on taxing crypto assets is not current law.
